Welcome to the Fairway View Estates HOA Rehabilitation Team Website. This website is hosted by our group made up of members of Fairway View Estates Homeowners.

The Fairway View Estates HOA Rehabilitation Team was formed in March 2018. The purpose of the "Team" is to:

  • Advocate for homeowners and HOA's for changes in the law to improve the management of HOA'S and eliminate unfair, unreasonable and unjust rules and procedures in homeowners associations.
  • Communicate needed changes to legislators and pursue the adoption of new laws regulating HOA'S.
  • Establish a means to broadly communicate information to all HOA members
  • Provide a forum for HOA members to raise issues and provide input to members of the HOA Board of Directors
  • Increase transparency regarding the governance of the HOA
  • Seek common ground in addressing issues to balance the interest of individual property owners and the Home Owners Association

Fairway View Estates is a beautiful neighborhood in a peaceful setting. As required by law the HOA has adopted a set of Covenants, Conditions, & Restrictions (CCRs), and Bylaws to help maintain the quality of life in our neighborhood.  The CCRs and Bylaws were last revised in approximately January 2016 and a majority of homeowners voted to approve the revised documents.

The HOA Board is responsible for enforcing the CCRs and Bylaws. Since the adoption of the revised CCRs and Bylaws some homeowners have expressed concerns that the HOA Board has inequitably applied the rules and/or been heavy-handed in their enforcement of the rules.  In addition, concerns have been raised about the HOA Board’s willingness to provide an open, transparent means to communicate with homeowners and the broader association when issues arise. Several homeowners’ inquiries about issues have been met with threats of litigation as a first response as opposed to the last resort.

It is the goal of the Rehabilitation Team to help inform all homeowners of significant issues affecting the operation of HOA'S and to help find solutions to issues before they rise to the level of litigation.  Further, the Rehabilitation Team through the creation of this webpage hopes to provide an easy and convenient forum to increase transparency about the operation and governance of our and other Homeowners Associations.

This is our HOA, we live here, we own the common area and the HOA Board is managing the common area for us. The appropriate role of the HOA Board is to collaborate with HOA members in performing their duties to balance all interests and seek workable solutions to issues that arise.  The focus of the HOA should be to resolve problems and be responsive to the homeowners they are elected to represent.

We will be posting a list of complaints and suggestions on how these complaints can be handled without the use of the HOA attorney.  We will list numerous issues of concern from HOA members and suggest solutions.  We believe most issues can be resolved by clear written policies rather than CCR changes.  

Many residents have requested the HOA develop and maintain a website for the Association but our Association refuses to do so and purposefully makes it difficult to communicate with the Board.
