Mediation isn't magic: it won't turn the aggressive, unreasonable idiot on the other side into a firm but reasonable model of good sense like you! In calmer moments, however, almost everyone thinks that putting a dispute to bed through reasonable compromise is better than the endless sleepless nights of a Court case.

Assisted Negotiation

Mediation isn't magic: it can't guarantee the outcome you want. But by speaking privately to each side in turn to find out how the parties are thinking, a mediator can work through your wishlist to help you put the possible outcomes into three categories: (1) what the other side will accept; (2) what they won't accept; and most important (3) what they probably will accept with a bit of movement from you. Once your lists overlap, you've both got a deal you can live with!

Getting on With Your Life

The outcome won't be perfect: mediation isn't magic, after all. Once you reach a deal, however, you will have something you can live with and will have shut down once for all the financial risks that litigation always brings - and just as important, given yourself the time and energy to start doing something more productive than paying lawyers to fight your battles. And if you don't manage to do a deal, well then, at least you have not damaged your case. The whole process is confidential, because everyone signs a contract not to disclose what happens during the negotiations; if you do end up in Court, therefore, the other side will not be able to tell the judge what you said during the mediation.
