Areas of practice.

Trademarks.

A trademark is your brand and helps to identify the source of your goods and services. All registered marks are valid throughout the United States and can last indefinitely as long as the owner continues to renew the mark and use the mark in interstate commerce.

We offer comprehensive trademark representation, including the application filings, trademark clearance searches, responding to office actions, post-allowance filings, trademark monitoring services, renewing trademarks, trademark assignment filings, defending and prosecuting proceedings in front of the Trademark Trial and Appeal Board (such as oppositions and cancellations), and enforcing trademark rights through trademark infringement litigation.


Copyrights.

A copyright is a form of ownership and legal protection for “original works of authorship.” The copyrighted work must be in tangible form. The Copyright Act generally gives the owner of the copyright the exclusive right to reproduce, prepare derivative works, distribute copies, publicly perform, or display the work of artistic expression. In cases of “works for hire” the employer and not the employee is considered the owner of the copyright.

We offer comprehensive copyright representation, including filing applications, corresponding with the Copyright Office, and enforcing and protecting copyrights through litigation.

PAtents.

A patent is a property right granted by the United States government only to the true inventor, excluding all others from making, using or selling the invention. Patents allow the holder exclusive right to make, use or sell the invention within the United States. In the United Stated, priority and defensive rights go first to the first true inventor who diligently reduces his invention to practice. This generally means that the first who not only invents but also quickly files for a patent will have preference over those that invent later, or those that delay an unreasonable amount of time to file their patent. Once you have a U.S. Patent, you can also carry over the priority date to many other countries.

Patents are granted for any new and useful process, machine, manufacture, or composition of matter. Although, in general, mathematical formulas are considered to be not patentable, recent changes have paved the way for patents protecting business methods and computer programs. Patents are not issued for perpetual motion machines, printed matter or mere “ideas”, but rather on the tangible expression of those ideas.

Amazon Brand Registry.

To that end, our firm offers comprehensive Amazon Brand Registry support services to enroll your eligible brands on the Amazon Brand Registry, which offers strong protection against trademark infringement on the Amazon marketplace.


Trade Secrets.

A trade secret is any information that is used in operating a business, which has some amount of value, is protected as a secret, and provides an actual or potential economic advantage over others.

The law allows you to protect your trade secrets if you meet certain legal requirement. However, unlike patents, copyrights, and trademarks, there is no office or agency where you can file a trade secret application and be issued an official trade secret certificate or registration. That would defeat the whole point!

Instead, the legal protection of trade secrets requires the owner alone to maintain its confidentiality and enforce it. If your trade secret becomes part of the public knowledge, its value is lost forever and you cannot stop others from using it.

That’s why it’s important to have diligent legal representation with respect to your business practices… before issues arise.
